Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the Monitor Keys application (the “Software”), provided free of charge by Fly-by-wire AB (“Company”, “we”, “us”), a company registered in Sweden. By downloading, installing or using the Software, you agree to these Terms. If you do not agree, do not use the Software.

2. Free License

The Software is free of charge for personal and commercial use. We grant you a non-exclusive, non-transferable, revocable license to install and use it in accordance with these Terms. You may not reverse engineer, resell or redistribute the Software except as permitted by applicable law.

3. What the Software Does, and Your Responsibility

You use the Software entirely at your own risk.

• The Software changes the volume of the sound your Mac sends to a monitor, and changes your monitor’s brightness through the monitor’s own control channel (DDC/CI). You are responsible for your listening levels and for your equipment and its settings.
• If the Software quits, stops working or is removed, sound returns to the level set on the monitor itself, which can be louder than the level you had chosen.
• The Software relies on macOS features, including ones Apple does not publicly document. An update to macOS or to your monitor may change how it works or stop it working.
• Not every Mac, monitor, cable, dock or keyboard works with the Software. What we list as compatible is based on our own testing and is not a guarantee.

4. Updates and Availability

The Software may check for and offer new versions. We have no obligation to provide updates, fixes or support, and we may change, stop distributing or discontinue the Software at any time without notice.

5. Disclaimer of Warranties

The Software is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Software will work with your Mac, monitor or keyboard, that it will be uninterrupted or error-free, or that it will not affect your equipment, settings or data.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Fly-by-wire AB, its owners, employees or suppliers be liable for any damages of any kind, whether direct, indirect, incidental, special, consequential or punitive, including damage to equipment, loss of data, and loss of profits, revenue or goodwill, arising out of or related to the Software or your use of or inability to use it, even if advised of the possibility of such damages.

The Software is free. To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the Software or these Terms is zero.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. In that case, our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law.

7. Indemnification

You agree to indemnify and hold harmless Fly-by-wire AB from any claims, damages or expenses arising from your use of the Software or your violation of these Terms.

8. Termination

You may stop using the Software at any time by quitting and deleting it. Sections that by their nature should survive termination will survive.

9. Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles. The courts of Sweden will have jurisdiction, subject to any mandatory consumer protections in your country of residence.

10. Changes and Contact

We may update these Terms from time to time; updated versions are posted here with a revised date, and continued use of the Software constitutes acceptance. For any question about these Terms, contact support@flybywire.se. See our Privacy Policy for how the Software handles data.
